Terms for AI Concepts & Designs

1. Introduction

These Terms ("Design Terms") govern the use of all creative content — including AI Concept images, CAD design files, render images, sketches, and associated media ("Content") — made available through the Jewellery Design Center ("JDC") platform by Universal Jewels and Diamonds.

By accessing, downloading, or using any Content through your JDC subscription, you agree to these Design Terms in addition to the general Terms of Use. Where these Design Terms conflict with the general Terms of Use, these Design Terms prevail for Content-related matters.

2. Licence by Subscription Tier

FREE Tier

Personal reference and inspiration use only. Free-tier Content may not be used for commercial purposes, client presentations, published marketing materials, or any revenue-generating activity.

Licence: Limited, non-exclusive, non-transferable licence for personal reference and design inspiration.
Credit requirement: Any online sharing of Content — on social media, websites, or otherwise — requires crediting JDC. Tag or mention our official profiles listed in Section 10.
Image downloads are not available on the FREE tier.

SILVER, GOLD & DIAMOND Tiers

Licence: Limited, non-exclusive, non-transferable licence for jewellery design inspiration, creation, client presentations, and business purposes.
AI Concept image downloads are available on SILVER+ tiers as permitted by your plan limits.
CAD and Render file downloads are available on applicable tiers per plan-level settings.
Credit requirement: Not required for business or commercial use, but you must not misrepresent authorship or claim the Content as your own original creation.
GOLD and DIAMOND subscribers may submit concept requests for bespoke AI-generated concepts subject to monthly limits and our concept request guidelines.

3. Restrictions — All Users

Regardless of subscription tier, the following restrictions apply to all Content:

No redistribution: You may not sell, sublicense, redistribute, or share Content files (images, CAD, video) with third parties as standalone assets.
No resale of Content: You may not include Content in stock image libraries, design marketplaces, or any platform where Content is made available for third-party download.
No NFTs or blockchain assets: Content may not be minted, tokenised, sold, or distributed as NFTs or other blockchain-based digital assets.
No AI training: Content must not be used to train, fine-tune, or build AI models, datasets, or derivative systems.
No authorship claim: You may not claim original authorship or copyright ownership of any Content.
No competitor use: Content may not be used on platforms that compete with JDC or in promotional materials for competing jewellery design services.
Business use clarification: You may manufacture and sell physical jewellery inspired by or based on Content. You are solely responsible for ensuring that any design you produce does not infringe third-party IP, trademarks, or patents.

3A. Permitted — Catalog Sharing

Sharing designs through JDC's built-in Catalog feature is permitted for all subscribers. Sending a catalog link to clients, colleagues, or business contacts is an intended and encouraged use of the platform — no credit or additional permission is required.

4. AI-Generated Content Disclaimer

All AI Concept images are generated using AI tools trained on publicly available datasets. As a result, Content may unintentionally resemble copyrighted or trademarked material. JDC cannot verify all intellectual property aspects of AI-generated outputs.

You are solely responsible for ensuring that your use of AI Concept Content is lawful in your jurisdiction and does not infringe third-party rights. If you receive a third-party IP claim related to Content, you agree to immediately cease use of the relevant Content and notify us at legal@jewellerydesigncenter.com.

5. Third-Party Brand, Character & IP Inspirations

JDC does not own, claim, or hold any rights — including copyright, trademark, or design rights — in any third-party intellectual property that may be reflected in or have inspired Content on this platform. This expressly includes, without limitation, luxury brand logos and trade dress, fictional characters from entertainment franchises, animated and comic-book characters, sports team emblems, and cultural or heritage motifs owned by third parties.

Content in the JDC library may include AI-generated concepts or design sketches that draw inspiration from recognisable brand aesthetics, character designs, or popular cultural imagery. Such Content is made available exclusively as creative reference material and design exploration — it does not represent an endorsement, affiliation, sponsorship, or licensing arrangement with any third-party brand, rights holder, or franchise owner.

No Claim of Rights; No Transfer of Rights

JDC makes no claim of copyright, trademark, or any other intellectual property right over elements in Content that originate from or are recognisably derived from third-party owned IP.
Your subscription to JDC does not grant you any licence, right, or clearance to use third-party IP embodied in or associated with inspired Content.
JDC does not and cannot authorise the manufacture, sale, or commercial distribution of physical jewellery or other products that incorporate protected third-party IP (including character likenesses, brand logos, or trademarked design elements) without independent authorisation from the relevant rights holder.

Subscriber Responsibility & Assumption of Risk

You are solely and entirely responsible for conducting your own intellectual property due diligence before commercially manufacturing, selling, or distributing any product based on or inspired by Content that features third-party brand or character elements.
If you choose to produce, market, or sell physical jewellery or other goods derived from such Content, you do so at your own legal and commercial risk.
JDC will not, under any circumstances, defend, indemnify, or accept financial or legal liability for claims brought by third-party rights holders arising from your use of inspired Content.

Claims Against JDC

JDC does not entertain, acknowledge, or accept third-party IP claims directed at the platform on the basis that Content may resemble or have been inspired by protected material. JDC's position is that AI-generated design inspiration content falls within the bounds of creative reference and transformative design exploration. Any third-party rights holder who believes Content on the platform infringes their IP should contact us at legal@jewellerydesigncenter.com with a detailed written notice, and JDC will evaluate and respond at its sole discretion. Submission of a claim does not constitute JDC's acceptance of liability.

6. Intellectual Property Ownership

All Content — including AI Concepts, CAD files, Render images, and associated metadata — is and remains the exclusive intellectual property of Universal Jewels and Diamonds / Jewellery Design Center. Your subscription grants a licence only; no ownership is transferred.

7. Limitation of Liability

JDC is not liable for financial losses, damages, or legal disputes — including third-party IP claims — arising from your use of Content. Subscription fees do not include legal indemnification for Content use.

8. Indemnification

You agree to indemnify and hold harmless Universal Jewels and Diamonds, its officers, employees, and agents from and against any claims, damages, or costs (including legal fees) arising from your misuse of Content or violation of these Design Terms.

9. Termination of Licence

Your licence to use Content is automatically suspended if your subscription lapses or your account is terminated for breach of these Terms. We reserve the right to revoke access to specific Content items at any time if we have reason to believe they infringe third-party rights. Downloaded Content must be deleted upon licence termination.

The provisions of Sections 3, 4, 7, 8, and 11 survive termination of the licence.

10. Governing Law

These Design Terms are governed by Indian law. Jurisdiction: Surat, Gujarat, India. Universal Jewels and Diamonds is the legal entity operating Jewellery Design Center (www.jewellerydesigncenter.com).
